Accurate Credit Reporting and Handling Direct Disputes: New Proposed Rules

A new proposed rule under the FACT Act appears to be on the fast track with a short comment period. The Interagency (and FTC) proposed rule would implement section 312 of FACTA, which deals with l) the accuracy and integrity of information furnished to credit reporting agencies; and 2) circumstances under which a furnisher must reinvestigate disputes about the accuracy of information contained in a credit report based upon a direct request from a consumer. FACT Act Review and Update

The Fair and Accurate Credit Transaction Act (FACT Act) became law on December 4, 2003. The FACT Act revises the Fair Credit Reporting Act (FCRA).The revisions result in substantial changes for all financial institutions. Many of the provisions were effective December 1, 2004. Other sections have become effective in recent months. This program reviews all of the revisions.
